Handling Appeals
You have your day in Family court; the parties testify, their lawyers present evidence, and make legal arguments. At the conclusion of the trial, the court announces its decision. You may be satisfied with all of it, or you may be dissatisfied with some of it. There may be a sound legal basis for appealing that decision. David Heiman has successfully handled appeals, and related procedures, for more than three decades. He can advise you about your appellate options.
Please bear in mind that when you are considering either an appeal, an application for a writ, or a related procedure, time is always a very important consideration. You need to start moving on your appeal right away because the mere passage of time will limit your ability to seek an appellate remedy, unless specific steps are taken during prescribed time periods. Sometimes, all of those steps are taken in just the appellate court, but often, there are steps that have to first be taken in the trial court, shortly after the time when the trial judge signs an order. It can be confusing, even to lawyers who don’t have adequate experience handling appeals. We have the experience to help cut through that confusion for you.
Protecting Children When a Parent Has a Substance Abuse Disorder
According to the National Institute of Mental Health, “A substance use disorder (SUD) is a mental disorder that affects a person’s brain and behavior, leading to a person’s inability to control their use of substances such as legal or illegal drugs, alcohol, or medications.
Having a Child Custody Case With Pending Criminal Charges Against You
In our practice, we see cases in which there is a pending criminal charge, such as for DWI, and a civil case, involving child custody issues. Sometimes, the criminal charge involves an alleged assault. Whenever we have one of these cases, we build our case on demonstrating the best interest of the child.
Is There an Ideal Time to File for Divorce?
One of the more common questions that we receive concerns when to file for divorce (another one is “(d)oes it matter who files first). There are several factors that go into figuring the timing.
What are the Different Types of Child Custody? (Part 2)
This is the second installment in this series. We previously discussed the allocation of parental rights, in Part 1. If you have not read that one already, or if you have, but need a refresher, please check-out that post.
Some Common Causes of Divorce (Part 1)
In my practice of law since 1989, my firm has handled many divorce cases, and have spoken with various mental health experts. Between our experience, as a law firm handling divorce cases, as well as what we have discovered from our study of the subject with relationship experts, we have learned some common causes of divorce.
What are the different types of Custody?
A common question that we get is whether it is possible for a client to get “full custody.” While “full custody” means different things to different people, it usually boils down to one of two things: either having the rights to make all parenting decisions for a child; or, having possession of a child, all of the time. We will discuss the first of those today. We will discuss possession issues later.
2021 Changes to the Texas Standard Possession Order
Since at least 1983, Texas child custody cases (or “Suits Affecting the Parent-Child Relationship,” or “SAPCR”) have been governed by a presumption in the Texas Family Code, providing that a “Standard Possession Order” should, typically, be entered by the court.
How to Expedite Your Divorce Case (Part 1)
All marriages have their ups and downs. A “down” period, by itself, is usually not reason to abandon a healthy marriage. But, of course, not all marriages are “healthy.” If you are unhappy in a marriage, visiting with a good therapist may be the first step in trying...
What if Your Child Does Not Want to Visit a Parent?
As the children of separated parents become older, they might express that they do not want to spend time with one of their parents. This, of course, causes trouble for the relationship between the child and parent, as well as the relationship between the parents.
What Are The Steps To Take After Deciding To Divorce? (Part 2)
As we stated there, ideally you would work through all of these steps before a divorce is initiated by either spouse. Your head will be clearer then, and you will be able to think without the stress of a pending divorce hanging over your head.

“Any and all aspects of my child custody case were handled expediently and professionally with David. The outcome of my case, even though dismissed, was as expected. Great attorney. Great service.“
“David Heiman handled my case for enforcement of child support. He had previously handled my divorce case. He did his homework. There were other factors in consideration at one of the Hearings where Mr. Heiman presented case law in order to get my case transferred to the court of jurisdiction. Mr. Heiman was empathetic and objective in working with me to realistically and properly address my concerns. He didn’t just tell me what I wanted to hear. He was able to look at the details of the case from both sides and he gave me great advice that ultimately produced favorable outcomes. The judges ruled in our favor EVERY TIME. Mr. Heiman is intelligent, impressive, compassionate and caring, and can bring out the humorous side of an unpleasant situation. Hire him! He will do no less than his very best to help you through it.“
“I can’t help but think I won the custody of my daughters because of the advice, help and support that David gave to me, from the first time I met him, right up to the time we won the custody case!!!”
